These Terms and Conditions (“Terms”) govern your access to and use of www.leadamant.com (the “Site”) and any purchases made from Lê Adamant LLC, a New Jersey limited liability company (“Lê Adamant,” “Company,” “we,” “our,” or “us”).

By accessing the Site or placing an order, you agree to be bound by these Terms.

If you do not agree, you must not use this Site.

2. Eligibility

You must be at least 18 years old to make purchases. By using this Site, you represent that you have legal capacity to enter into binding agreements.

 

3. Made-to-Order & Custom Production

All jewelry sold by Lê Adamant is made-to-order and produced according to customer-selected specifications, including but not limited to:

Metal type (14k or 18k gold, platinum)

• Metal color (yellow, white, or rose)
• Ring size
• Bracelet or necklace length
• Carat weight (where applicable)

Because each item is manufactured specifically to your selected configuration, all items constitute customized goods produced to consumer specifications.

Production timelines are estimates only and are not guaranteed.

 

4. No Returns – All Sales Final

Due to the custom-made nature of our jewelry:

All sales are final. We do not accept returns or offer refunds.
This policy applies once production has begun.

Exception:

• Verified manufacturing defects (see Warranty section)
• Where required by applicable mandatory consumer protection law

For customers in the EU, UK, and other regions with statutory cooling-off rights:

Customized goods made according to consumer specifications are exempt from standard withdrawal rights under applicable consumer regulations.

 

5. Size Exchange Policy (Limited)

We offer a one-time size exchange under these strict conditions:

• Request must be made within 48 hours of confirmed delivery.
• Item must be unworn and in pristine condition.
• Applies only to standard designs (no engraved or modified items).
• Customer pays return shipping.
• We cover shipping of the corrected size.
• Processing time: 7–10 business days after the item is received.

We reserve sole discretion to deny exchanges that do not meet eligibility requirements.

 

6. Orders & Payment

We reserve the right to:

• Refuse or cancel any order
• Limit quantities
• Request identity verification
• Cancel suspected fraudulent transactions

Accepted payment methods include credit cards and Shop Pay Installments.

By submitting payment information, you authorize us to charge your payment method.

 

7. Shop Pay Installments

Installment payments are offered through Shop Pay and its third-party financial partners.

Lê Adamant LLC:

• Is not a lender
• Does not control approval decisions
• Is not responsible for financing terms, interest, or payment disputes

All installment agreements are solely between you and the financing provider.

 

8. Pricing & Errors

We reserve the right to correct:

• Pricing errors
• Typographical errors
• Incorrect product descriptions

If an error affects your order, we may cancel and issue a refund prior to shipment.

 

9. Shipping, Insurance & Risk of Loss

All shipments:

• Are fully insured
• Require signature confirmation upon delivery

Title and risk of loss transfer to the customer upon confirmed signature delivery by the carrier.

Proof of delivery provided by the shipping carrier constitutes conclusive evidence of delivery.

We are not responsible for:

• Packages left unattended after signature
• Theft after confirmed delivery
• Delays caused by carriers or customs
• Incorrect shipping addresses provided by customers

Claims regarding shipping issues must be submitted within 48 hours of confirmed delivery.

 

10. International Shipping, Duties & Taxes

Customers outside the United States are responsible for:

• Import duties
• VAT
• Customs fees
• Brokerage charges
• Local taxes

If a shipment is refused, the customer is responsible for:

• Return shipping fees
• Customs charges
• Insurance costs
• Any carrier penalties

We are not responsible for customs delays.

Currency conversions are handled by your payment provider.

 

11. Warranty (1 Year Limited)

We provide a 1-year limited warranty covering manufacturing defects.

This warranty does NOT cover:

• Normal wear and tear
• Scratches or surface marks
• Tarnishing
• Damage from misuse or improper care
• Third-party resizing or modification
• Accidental damage

We reserve the right to:

• Repair the item
• Replace the item
• Deny the claim if criteria are not met

Customers are responsible for shipping items to us for warranty evaluation.

 

12. Jewelry Characteristics Disclaimer

Due to the handcrafted and natural nature of fine jewelry:

• Gold weight may vary slightly
• Carat weight may vary within industry tolerance
• Natural gemstones may display inclusions or color variations
• Color appearance may vary depending on lighting and screen display

These characteristics are not defects.

 

13. Fraud Prevention

We reserve the right to:

• Request identification verification
• Cancel suspicious orders
• Refuse high-risk transactions
• Report fraudulent activity to authorities

Chargeback abuse may result in permanent refusal of service.

 

14. Intellectual Property

All content, designs, logos, images, and product designs are the exclusive property of Lê Adamant LLC.

Unauthorized reproduction or distribution is prohibited.

 

15. Limitation of Liability

To the maximum extent permitted by law:

Lê Adamant LLC’s total liability shall not exceed the purchase price paid for the product.

We are not liable for:

• Indirect damages
• Consequential damages
• Loss of profits
• Emotional distress
• Shipping carrier negligence
• Third-party service failures
  

 

16. Indemnification

You agree to indemnify and hold harmless Lê Adamant LLC from any claims, damages, or expenses arising from:

• Breach of these Terms
• Misuse of products
• Violation of applicable laws

 

17. Export Compliance

You agree to comply with all U.S. export laws and sanctions regulations.
We do not ship to prohibited jurisdictions.

 

18. Force Majeure

We are not liable for delays or failure due to events beyond our control, including:

• Natural disasters
• Carrier disruptions
• Government restrictions
• Supply chain interruptions
• Acts of war
• Pandemics

 

19. Arbitration & Class Action Waiver

Any dispute shall be resolved exclusively through binding arbitration in the State of New Jersey under the Federal Arbitration Act.

You agree:

• To waive any right to jury trial
• To waive participation in class actions
• That arbitration will be conducted individually

Small claims court actions are permitted where applicable.

 

20. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.

 

21. Electronic Communications

By using this Site, you consent to receive electronic communications, including order confirmations and legal notices.

Electronic agreements are legally binding.

 

22. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

 

23. Entire Agreement

These Terms constitute the entire agreement between you and Lê Adamant LLC regarding use of the Site and purchases.

24. Modifications

We reserve the right to update these Terms at any time. Continued use of the Site constitutes acceptance of revised Terms.
